Terms of Service

PLEASE READ CAREFULLY BEFORE USING THE www.WAA.world (or https://waa.world) AND RELATED OR AFFILIATED SERVICES.

This Terms of Service applies to the Member and ANYONE who accesses or uses the services. And you acknowledge that you have read, understood, and agreed to be bound by any and all the terms of service. If you disagree with any part of these terms, do not access or use these services (and including but not limited to, any and all related or affiliated systems, programs, connections, communications, sites, addresses, and procedures, etc.). Therefore, your access to and use of the services are conditioned on your agreement of and acceptance with this Terms of Service and any and all codes of conduct.

Definitions

The www.WAA.world (“WAA site”, “we”, “us”, or “our”) and the mobile application are an online service platform operated by the World Association of Artists™ ℠ ® (“WAA”, “we”, “us”, or “our”, a FBN of 787, Inc) on the World Wide Web running on the Internet. (The Chairman of 787, Inc is also the Chairman of the WAA.) The Member or ANYONE (“you” or “your”) represents each individual age 18 or older agrees and accepts this Terms and Policy (TERMS OF SERVICE & PRIVACY POLICY) and any and all codes of conduct of the World Association of Artists™ ℠ ® (“WAA”); joins the WAA and creates an account for access to and use of the WAA site. Each joiner should submit three (3) own artworks to the WAA for reviewing and evaluating. If not meeting the WAA minimum membership requirements, the joiner will receive a money-back refund (excluding any transaction fees). And you may reapply for the WAA member after one year.

English is the official and legal language of the WAA site and any related or affiliated services, etc. There are some multilingual translations (partial or whole) for your choices. However, due to the accuracy of all multilingual translations is not guaranteed (such as ”世界美术家协会”, it’s translated to “世界艺术家协会”, etc.), therefore, any translations are for reference ONLY.

Due to the U.S. Government restrictions, the WAA is unable to accept any level memberships and art competition entries from Syria, Iran, North Korea, or Crimea.

Changed Terms of Service

This Terms of Service is effective as of May 26, 2021, and will remain in full force and effect except with respect to any modifications in its provisions in the future, which will be in effect immediately after being posted on the WAA site.

The WAA shall reserve the right at any time to change, amend, suspend, or terminate any features, terms, and policies of the WAA site (and/or any related or affiliated entities, etc.), including but not limited to, contents, requirements, availabilities, regulations, fees, charges, and equipments, etc. And you should check this Terms of Service periodically. Your continued use of the service after we post any changes to the Terms of Service on the WAA site will constitute your acknowledgment of the changes and your consent to abide and be bound by the revised Terms of Service.

Member

As a Member, you can only have one active account. After paying the membership fee and being approved for eligibility, you will receive your Certificate of Membership (and/or other documents, if applicable) on the WAA site only. The World Association of Artists™ ℠ ® (“WAA”) will NOT ship a certificate (or other documents) to you through the mail (or others). The WAA contacts its Members directly only. And the most contacts between the WAA and the Members are by email; so each Member must keep your email address up to date in the WAA site system at all times. And you have the sole responsibility to secure and maintain your username and password. If you do not reply to any notices and emails of the WAA in seven days, we may take your unresponsiveness as notification that you have read, understood, agreed, accepted, and consented to the contents. To all benefits of membership depend on the voluntary participation of members (per your submitting and request in membership period).

You shall be solely liable and responsible for ensuring that you submit, upload, and post content that complies with applicable copyright laws. The whole artworks were created by you, and you must be the 100 percent copyright owner of any and all artwork images. The contents you submit, upload, and post will be viewed by the public. Therefore, you shall only provide content that you are comfortable being made public under this Terms of Service. You are agreeing to use the WAA site only for lawful purposes (including but not limited to, under the United States laws, your local laws, and international laws). And you are also agreeing not to use the WAA site to advertise or perform any commercial solicitation matters. You shall be solely responsible for obtaining, paying, and maintaining any and all hardware, software, third party services and other equipments needed for accessing and using the services.

Good Friend Certificate

As per the WAA membership requirements, each joiner should submit three own artworks through https://waa.world/submitting-artwork-for-gallery/ to the WAA for the purpose of reviewing and evaluating the participant’s qualification. If without receiving the joiner’s artworks after 90 days of registering, the WAA will issue a “The WAA Good Friend Certificate” (instead of a Certificate of Membership) to him/her. The holder of the Good Friend Certificate will not have any membership benefits.

www.WAA.world

As a Member, you are agreeing and granting the www.WAA.world (“WAA site”), including but not limited to, the World Association of Artists™℠® (“WAA”), 787, Inc, and/or any related or affiliated entities, etc., a worldwide, royalty-free, non-exclusive, and perpetual license/right to use, including but not limited to, host, display, post, print, publish, reproduce, show, distribute, and perform all of your submissions (sending in any way from anywhere to us and our any places, etc.). If you sell your work(s), you are responsible for the new owner(s) continuing to agree and grant these rights to the WAA, etc. Also, you are agreeing and granting that the www.WAA.world (“WAA site”), the World Association of Artists™ ℠ ® (“WAA”), and 787, Inc can use all of your submissions in any and all manner and media of the www.WAA.world (including but not limited to, http://WorldAssociationofArtists.org, http://ArtPomo.com, http://Narrationism.com, http://twitter.com/ArtPomoNews, http://twitter.com/WAAdotWorld, and the WAA YouTube channels, etc.) and that the www.WAA.world (“WAA site”), the World Association of Artists™ ℠ ® (“WAA”), and 787, Inc shall have the right to authorize third parties to do so as well. The WAA site may modify, manipulate, or adjust your content(s) for any editorial reasons, technical requirements, or limitations, etc. Such any and all uses by the www.WAA.world (including but not limited to, http://WorldAssociationofArtists.org, http://ArtPomo.com, http://Narrationism.com, http://twitter.com/ArtPomoNews, http://twitter.com/WAAdotWorld, and the WAA YouTube channels, etc.) shall be made with no compensation paid to you with respect to any and all information, contents, materials, or anything else that you submit, upload, post, or otherwise make available to the WAA, etc.

The WAA site shall reserve the right, but not the obligation, to monitor any contents posted to the site, to determine compliance with this Terms of Service and any operating rules established by the WAA site and to satisfy any applicable laws, regulations, legal processes or governmental requests. The WAA site shall reserve the right in its sole discretion to edit, change, manipulate, operate, remove, delete, or refuse to accept (and post) any information, contents, materials, or anything else on the WAA site.

Membership Fee

The WAA membership fee is yearly and the cycle begins the day you join until the following year. Therefore, the annual fee is due each year on the participation day of the anniversary month. You have a grace period of 30 days to pay your due. If the WAA does not receive the Member’s renewal payment after the grace period, your account will be closed. Due to the joiner’s account is terminated, ALL the information/data, etc. that you have provided through our services may be permanently deleted, etc. from our system. It is important to be aware that you will not be able to access and use the services after your account is closed. When you make any payment(s) and/or any submission(s) to the WAA (and including but not limited to, any related or affiliated places, etc.) through any methods and anywhere, you acknowledge that you have read, understood, and agreed to our Terms of Service and Privacy Policy. If your fee is paid by a third party, the payer needs to email the WAA immediately (using the same name and email address as making the payment) for the notification.

Payment

By purchasing your annual membership fee (or anything else), you are agreeing that ALL payments are NON-REFUNDABLE. If you are not qualified for membership after submitting three own artworks to the WAA for reviewing and evaluating, the WAA provides a money-back guarantee (excluding any transaction fees).

Submitting Artwork for Gallery

As a Member, you may submit up to THREE (3) JPEG images of your artwork and ONE (1) self-portrait, at 100 DPI resolution, with the MINIMUM FILE SIZE 500X500 Pixels and the MAXIMUM FILE SIZE 700X700 Pixels (0.5 MB) for each image for your own name gallery (regular and/or virtual viewing). Important: We can only accept jpegs and through the link of https://waa.world/submitting-artwork-for-gallery/. Please do not submit other format files and through any other places. If you do so your submission will not be reviewed. Attention: Each Member only has ONE (1) his/her own name gallery with a maximum of THREE (3) artworks and ONE (1) self-portrait. When uploading a new submission, you will replace your previous submission and lose your previous gallery setting and image(s). The total annual submission is FIVE (5) times for each Member.

You are agreeing and granting the www.WAA.world (“WAA site”), including but not limited to, the World Association of Artists™℠® (“WAA”), 787, Inc., and/or any related or affiliated entities, etc., to display/use your gallery/competition contents, images, and any information, etc. (including after membership termination). And the WAA site, etc. shall be made with no compensation paid to you (see section “www.WAA.world” and other sections for details).

The WAA Annual International Art Competition

When a Member uploads his/her artwork(s) and builds (publishes) for the gallery, the submission will automatically participate in the WAA Annual International Art Competition after completing his/her gallery page. All entries will be viewed, evaluated, and selected by the WAA. The WAA will notify the final winners through their emails and post the winners list and their artworks on the WAA Competition site and/or social media websites. The WAA will also issue the official WAA Winner Certificates to all winners. However, each year’s competition will depend on the Member’s total number of the related art category at the time. Therefore, the Annual International Art Competition cannot be guaranteed by the WAA.

Submitting Artwork for Diagnosis

As part of the WAA benefits, you may submit JPEG images of your pieces of art for artwork diagnosis, at 100 DPI resolution, with the MINIMUM FILE SIZE 500X500 Pixels and the MAXIMUM FILE SIZE 700X700 Pixels (0.5 MB) for each image. Important: We can only accept jpegs. Please do not submit other format files. If you do so your submission will not be reviewed and diagnosed. The first one artwork will be the FREE diagnosis for our members (for each membership year). After that, the current member can enjoy a special discount price for each extra artwork. (And we temporarily do not accept non-members’ artwork diagnosis.)

The WAA Video Channels (or Productions)

You are agreeing and granting that the www.WAA.world (“WAA site”), including but not limited to, the World Association of Artists™℠® (“WAA”), 787, Inc., and/or any related or affiliated entities, etc., can permanently use all of your submissions (through anywhere) to conduct the following (including but not limited to):

  • Modifying, manipulating, and reformatting your content(s), etc.
  • Using your content(s) with/without other content(s), such as, video(s), audio(s), and image(s), etc.
  • Creating the video(s) for you (or for other purposes)
  • Publishing and displaying the video(s) in any places (including but not limited to, YouTube, etc.)
  • Sublicensing these rights to others, such as our related parties, etc.
  • Allowing others to like, share, and subscribe the video(s), etc.

The www.WAA.world (“WAA site”), including but not limited to, the World Association of Artists™℠® (“WAA”), 787, Inc., and/or any related or affiliated entities, etc., shall not pay you anything at all (see section “www.WAA.world” and other sections for details).

Introduction and Promotion

All the introductions and promotions on the social media websites are not guaranteed (such as: Twitter, etc.).

Copyright

The WAA site respects the rights of all copyright holders and in this regard, has adopted and implemented a policy that provides for the removal of the Member who infringes on the rights of copyright holders. If the aggrieved party believes that your work has been copied in a way that constitutes copyright infringement, you should notice the WAA site (or the WAA) immediately.

Warranty

As a Member, you understand and agree that the use of the WAA site is at your own risk. Neither the WAA site, its affiliates nor any of their employees, agents, or the related party content providers warrant that the WAA site will be error-free or uninterrupted; nor as to the carefulness or correctness, reliability or content of any information, event, or service provided through the WAA site. The WAA site is provided on an “as is” basis without either expressed or implied warranties or conditions of any kind.

Liability

The WAA site disclaimer of liability and warranty applies to any damages, injuries, or anything else, including but not limited to, those caused by any failure of performance, error, mistake, omission, defect, affect, inaccuracy, interruption, deletion, delay, virus, theft, destruction or unauthorized access to, alteration of, or use of record, whether for breach of agreement, tortious conduct, disregard, negligence, or under any other cause of action. You shall be solely responsible for obtaining, paying, and maintaining any and all hardware, software, third party services, and other equipments needed for accessing and using the services. Moreover, you clearly accept and acknowledge that the WAA site (and/or any related or affiliated entities, etc.) are not liable for any and all illegal conducts of any and all parties and that the risk of damage or injury from the foregoing rests entirely with you.

In addition to this Terms of Service set forth above neither, the WAA site, nor its affiliates, information providers, or anything else shall be liable regardless of the cause or duration, for any errors, mistakes, omissions, defects, affects, inaccuracies, interruptions, uncertainty, untimeliness, or authenticity of, the information and content contained within the WAA site, or for any delays, interruptions or discontinuations, or for any restorations, losses, or claims.

Prior to the execution, the Member and ANYONE who accesses or uses the services shall consult with your professional advisers or others to verify any and all information or anything else at your own expenses. Therefore, the Member and ANYONE who accesses or uses the services hereby fully relieve the www.WAA.world (“WAA site”), including but not limited to, http://WorldAssociationofArtists.org, http://ArtPomo.com, http://Narrationism.com, http://twitter.com/ArtPomoNews, http://twitter.com/WAAdotWorld, the World Association of Artists™ ℠ ® (“WAA”), 787, Inc, and their employees or agents of any and all liabilities therefore and completely release, waive, and discharge the www.WAA.world (“WAA site”), including but not limited to, http://WorldAssociationofArtists.org, http://ArtPomo.com, http://Narrationism.com, http://twitter.com/ArtPomoNews, http://twitter.com/WAAdotWorld, the World Association of Artists™ ℠ ® (“WAA”), 787, Inc, and their employees or agents from any and all rights, claims, demands, obligations, and actions, etc.

The Member and ANYONE who accesses or uses the services are liable for any damages, injuries, and abuses, including but not limited to, direct, indirect, accidental, fatal, and unusual to use the WAA site in any way. If you let others do anything for you on the WAA site (and/or any related or affiliated entities, etc.), you shall take any and all responsibilities at your own expenses. And you must not send any and all fake, abusive, fraudulent, and illegal messages to the WAA site (or any related third party associated), or post and spread such messages in any public and nonpublic forums.

Termination

The WAA site or the Member, either party may terminate the relationship of this Terms of Service at any time. Without prejudice to the generality of the foregoing, the WAA site shall reserve the right to immediately terminate the Member’s active account in the event of any breach by the Member of any of this Terms of Service.

This TERMS OF SERVICE shall be governed by the laws of the State of California, USA and any disputes shall be resolved in San Diego County.

Who We Are

The www.WAA.world (“WAA site”, “we”, “us”, or “our”) and the mobile application, or any related products and services are an online service platform operated by the World Association of Artists™ ℠ ® (“WAA”, “we”, “us”, or “our”) on the World Wide Web running on the Internet. This page informs you of the WAA site’s policies regarding the collection, management, use, processing, sharing, and disclosure of both “Personal Information/Data” and “Anonymous Information/Data” we receive, collect, and process from our users of the WAA site.

We use your “Personal Information/Data” and “Anonymous Information/Data” only for providing and improving the site. By using the WAA site, you understand and agree that through your use of the WAA site service you consent to the collection and use of information/Data in accordance with this Privacy Policy.

  • Phone, Street, City, State, Zipcode, Country and Company Name (The optional information is for your profile.)

If your fee is paid by a third party, we may keep the payer’s information (Name, Email Address, and Phone Number, etc.) for the record of your account.

Via Our Support Services:
If you contact us via our support services (such as: “Contact”), we may receive, collect, and process the following information/data from you:

  • Name
  • Email Address
  • Subject
  • Message
  • Your Consent, etc.

We may keep contact form submissions in a short period of time for customer service purposes, but we do not use the information submitted for marketing purposes.

Submitting Artwork for Gallery, Competition, or Diagnosis:
If you submit your artwork(s) for Gallery, Competition, or Diagnosis, we may receive, collect, and process the following information/data from you:

  • Your Name
  • Your Email
  • Category
  • Content (Artist Bio/Statement, Artwork Title, and Description, etc.)
  • reCAPTCHA
  • Artwork Image(s), etc.
  • Your Consent, etc.

If you upload your image(s) to the WAA site, you should avoid uploading image(s) with embedded location data (EXIF GPS) included.

And also your Internet Protocol (“IP”) address and browser user agent string in order to help spam detection.

Why We Collect It

Using Your Information/Data:
The WAA and our service providers may use the information/data collected from you to:

  • Improve Our Services
  • Communicate with You
  • Allow You to Participate in Activities
  • Introduce or Promote You and Your Work(s)
  • Process Your Orders, Suggestions, and Requests
  • Provide You with Our Customer Services and Supports, etc.

Who We Share Your Data With

Checkout and Sharing:
If you purchase the WAA membership program or others, our system will transfer/redirect you to an offsite payment gateway when you are ready for subscription. We may share your information/data with payment processors (such as: PayPal, etc) for the purposes of processing your payments. The third party service providers may also collect and store your information/data for processing your purchase and other needs.

We may also share your information/data with our other websites and social media sites (such as: http://WorldAssociationofArtists.org, http://ArtPomo.com, http://Narrationism.com, http://twitter.com/ArtPomoNews, and http://twitter.com/WAAdotWorld, etc), and the third party websites or services for the purposes of introducing or promoting you and your artwork(s), etc.

Some of the systems that we use to manage your information/data and others are controlled by the third party providers. The WAA has not sold and will not sell your information/data to any third parties.

How We Protect Your Data

Data Storage and Security:
We use the web hosting service provider to host the information/data we collect, and your information/data is secured by its technical measures in the USA (or other places).

The security of your Personal Information is very important to us. However, please be aware that NO method of transmission over the Internet or network, or method of electronic storage, can be 100 percent secure. Therefore, while we strive to use commercially acceptable means to protect your personally identifiable information, we are unable to guarantee the absolute security.

What Rights You Have over Your Data

Control and Access of Your Information/Data:
You have the legal right at any time to ask for access to your information/data for amending, objecting, declining, deleting or subjecting to restrict processing.

If you would like us to permanently delete all the information/data that you have provided through our services, please contact us directly at privacy@waa.world. But it is important to be aware that you may not be able to access and use the services after your information/data is deleted.

You have the right to see or obtain a copy of your information/data that we maintain as well as to ask us to make corrections to incomplete or inaccurate information/data. You also have the right to receive data that you have provided to us in a machine-readable format and to transmit that data to another controller. Cookies Policy

Cookies are files with a small amount of data, which may contain an anonymous unique identifier. Cookies are sent to your browser from a website and transferred to your device.

However, if you do not accept cookies, it is important to be aware that you may not be able to use some features or services of the WAA site.

Log Data

Like a lot of site operators, we may collect information that your browser sends whenever you visit the WAA site (“Log Data”).

This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of the WAA site that you access, the time and date of your visit, the time spent on those pages and other statistics.

Embedding Content from Other Sites

Our site may include embedded contents (such as: articles, images, videos, etc.). Embedded contents (from other websites that are not controlled or owned by the WAA) behave in the exact same way as if the user (visitor) has visited the other website. Therefore, the WAA assumes no responsibility for your privacy or the content of these websites.

Service Providers

The WAA may employ third party companies and individuals, including but not limited to, vendors, suppliers, and advisors to facilitate our provision of the services, to provide the services on our behalf, to perform service-related services and/or to assist us in analyzing how the WAA site is used. These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use it for any other purposes. (But these third parties are not controlled or owned by the WAA.)

California Privacy Rights

The WAA may share your personal information as defined by California’s “Shine the Light” law with certain of our affiliates and other third parties for marketing purposes. Communications

The WAA may use your Personal Information to contact you with notifications, newsletters, and others that may be of interest to you. You may opt-out of receiving any, or all, of certain communications from us at any time by following the instructions provided in any emails we send or by contacting us directly.

Compliance with Laws

The WAA will disclose your Personal Information where required to do so by law or subpoena or other legal processes or if we reasonably believe that such action is necessary to comply with the law and the reasonable requests of legal enforcement or to protect the security or integrity of our site.

Do Not Track Disclosure

The WAA does not support Do Not Track (“DNT”). DNT is a preference you can set in your web browser to inform websites to opt-out of online behavioral tracking. You can enable or disable DNT by going to the Preferences (or Settings) page of your web browser. (Each browser may vary, check your browser’s Help Menu for the detailed instructions.)

International Transfer

Your information, including “Personal Information/Data” and “Anonymous Information/Data”, may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside the United States and choose to provide information to us, please be aware that the web hosting service provider may transfer the information, including “Personal Information/Data” and “Anonymous Information/Data”, to the USA (or other places) and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer, processing, and storage.

Linking to Other Sites

The WAA site may contain links to third party websites or services that are not controlled or owned by the WAA. Therefore, the WAA assumes no responsibility for, including but not limited to, the content, privacy, or otherwise of any of their websites or services. You further acknowledge and agree that the WAA site will not be responsible or liable for any and all actual or alleged damages or losses.

Minor’s Privacy

Only individuals age 18 or older have permission to access the WAA site service. The WAA service does NOT address anyone under the age of 18 (“Minor” or “Child”).
